RailBird is a mobile app for tracking poker sessions and connecting with other players. By using RailBird, you agree to follow the rules below, including acceptable use, respecting others, and not using the app for unlawful or abusive activity. If you violate these terms, your account may be restricted or terminated.
RailBird ("RailBird," "we," "our," or "us") is a mobile application owned and operated by Short Stack Software. These Terms of Service ("Terms") govern your access to and use of the RailBird mobile application, related websites, and services (collectively, the "Services").
By creating an account, accessing, or using the Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Services.
You must be able to form a binding contract in your jurisdiction to use the Services. You are responsible for ensuring your use of the Services is lawful where you live and where you use the Services.
RailBird provides tools for tracking poker sessions, social features (friends, messaging, activity), notifications, and venue-related information such as waitlists or check-in flows where supported.
RailBird does not operate games, does not run a casino, and does not process gambling wagers. Any venue information shown in the app may be provided by venues, third parties, or users and may change over time.
The Services may allow you to submit or share information such as profile details, messages, notes, and other content ("User Content"). You are responsible for your User Content.

Messaging and social features are provided for legitimate social use. We may offer tools to report, block, or flag content and users. We may investigate reports and take action as described in Section 8.
The Services, including software, design, logos, and content provided by RailBird (excluding User Content), are owned by Short Stack Software or its licensors and are protected by intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of our Services without our written permission.
We may (but are not obligated to) monitor the Services and enforce these Terms. We may suspend or terminate your account, or restrict access to features, at any time if:
You may stop using the Services at any time. If the Services include an in-app option to delete your account, you may use it; otherwise contact us to request deletion.
The Services may contain links to third-party websites or services (for example, venue websites or external resources). We do not control and are not responsible for third-party content, policies, or practices. Your use of third-party services is at your own risk.
AS IS: The Services are provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
Accuracy: We do not warrant that venue data, waitlist status, notifications, or other information will always be accurate, complete, or current.
To the fullest extent permitted by law, Short Stack Software and its affiliates, officers, employees, agents, and partners will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, goodwill, or other intangible losses, arising out of or related to your use of (or inability to use) the Services.
You agree to defend, indemnify, and hold harmless Short Stack Software from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising from or related to your use of the Services, your User Content, or your violation of these Terms or applicable laws.
We may update these Terms from time to time. If we make material changes, we may provide notice through the Services or other reasonable means. By continuing to use the Services after changes become effective, you agree to the updated Terms.
These Terms are governed by the laws of the jurisdiction where Short Stack Software is established, without regard to conflict of law principles, unless applicable law requires otherwise.
